Terms of Service

Effective date: April 23, 2026

1. Overview

PHX Creator Space provides studio rentals, creative environments, and related services in downtown Phoenix, Arizona.

By using our services, visiting our website, or entering our space, you agree to these Terms of Service and to our Privacy Policy. A separate Liability Waiver applies when you book or use the studio.

2. Bookings & payments

  • All bookings must be paid in advance unless we agree otherwise in writing.
  • Pricing, packages, and add-ons are subject to change; published rates apply at checkout.
  • Late or unpaid balances may result in cancellation of the reservation and forfeiture of deposits or prepayment as set out in these Terms.
  • A refundable security deposit (currently $250) may be required for bookings or equipment use; treatment of that deposit on cancellation follows section 3, and damage or loss may be charged against it as described in sections 5 and 6.
  • A valid government-issued photo ID and a payment card in a matching name may be required at check-in; a copy of ID may be retained for the rental period as permitted by law.

3. Cancellation policy

Refund eligibility for deposits and prepaid studio fees is based on how far in advance you cancel before your scheduled start time, unless we agree otherwise in writing:

  • 48+ hours before start: full refund of amounts eligible under this policy (e.g. deposit or prepaid session fees we designate as refundable).
  • 24–48 hours before start: 50% refund of those same eligible amounts.
  • Less than 24 hours before start: no refund of deposit or prepaid fees, except where required by law.

No-shows (failure to arrive without timely cancellation) are non-refundable.

When you complete a booking and pay online, you confirm you have read this cancellation policy.

4. Use of space

You agree to:

  • Use the space safely and respectfully and leave it ready for the next guest.
  • Follow all posted rules, house policies, and reasonable instructions from staff.
  • Not engage in illegal, dangerous, or hazardous activities on the premises.
  • Use equipment responsibly: do not force or modify gear; return equipment to its original location; keep cables neatly coiled.
  • Respect occupancy limits, fire codes, and any capacity limits we communicate.

5. Equipment use

  • Included or rented equipment is used at your own risk.
  • You are responsible for damage, loss, or misuse attributable to you or your guests.
  • Report malfunctions, damage, or safety issues to us immediately.

6. Damages & liability

You agree to:

  • Cover repair, replacement, or cleaning costs for damage to the space, fixtures, or equipment caused by you, your team, or your guests, including amounts charged to your deposit or payment method where permitted.
  • Accept responsibility for the conduct of everyone you bring into the session or event.

Theft or intentional damage to the space or gear may be reported to law enforcement and pursued under applicable law.

7. Assumption of risk & waiver

By entering and using the space, you acknowledge that:

  • You assume all risks related to use of the facilities, equipment, cabling, lighting, and other production activities.
  • To the fullest extent permitted by law, you release PHX Creator Space and its owners, staff, and contractors from claims for injuries, property damage, or losses arising from your rental or event, except where caused by our gross negligence or willful misconduct (as determined by a court of competent jurisdiction).

Some jurisdictions do not allow certain waivers; if any part of this section is unenforceable, the remainder stays in effect to the maximum extent allowed.

8. Limitation of liability

To the maximum extent allowed by law, PHX Creator Space is not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, lost data, or business interruption
  • Failures of third-party services (including payment, email, calendar, or hosting providers)

Where a limitation is not permitted, our aggregate liability for any claim arising out of these Terms or your use of the services is limited to the amount you paid us for the booking giving rise to the claim in the twelve (12) months before the event, unless a higher minimum applies under mandatory law.

9. Media release

Unless you request otherwise in writing to [email protected], you grant PHX Creator Space a non-exclusive, royalty-free license to use photos and videos taken in or of the space during your session or event for marketing and promotional purposes (including online and social media). 10. Prohibited activities

You may not:

  • Damage, deface, or remove property that does not belong to you
  • Harass, threaten, or discriminate against staff, other guests, or neighbors
  • Use the space for unlawful purposes or in violation of lease, zoning, or permit rules
  • Exceed stated occupancy or use the space in a way that endangers people or the building

11. Termination

We may refuse service, end a session early, or cancel future bookings if you violate these Terms, create a safety hazard, fail to pay, or misuse the space or equipment. Fees already earned or forfeited under the cancellation policy may apply.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. You agree that exclusive venue for disputes arising from these Terms or your use of the studio lies in the state or federal courts located in Maricopa County, Arizona, subject to any consumer protections that apply where you live.
